For clarity within this document:

• “Products” (also referred to as “artifacts”) include all physical goods sold, such as candles, wax melts, jewelry, apparel, and related items.

• “Digital Products” include downloadable or digital content.

• “We,” “us,” “our,” and “Ash & Prose” refer to Ash & Prose, LLC, a registered U.S.-based business operating out of Colorado.

These Terms of Service (“Terms”) govern your access to and use of our website, Shopify storefront, Etsy shop, and all related digital experiences (collectively, the “Services”). By accessing our website or completing a transaction, you agree to be bound by these Terms and our Privacy Policy.

SECTION 1 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We strive to ensure all information on this site is accurate, complete, and current; however, errors may occur. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, or more timely sources of information. Any reliance on the material on this site is at your own risk. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 2 — GENERAL CONDITIONS & RIGHT TO REFUSE SERVICE

We reserve the right to refuse service to anyone for any lawful reason at any time. You understand that your content (excluding payment information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements. Payment information is always encrypted and processed securely via PCI-compliant providers, including Shopify Payments. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from Ash & Prose, LLC.

SECTION 3 — ACCESS & ACCOUNT RESPONSIBILITY

You must be the age of majority in your jurisdiction to use the Services. If you permit a minor to use the Services through a device you control, you accept full responsibility for their actions. You are responsible for safeguarding your account credentials. Accounts and digital access keys are non-transferable.

SECTION 4 — ELECTRONIC COMMUNICATIONS

By using our Services or communicating through text, emails, our Contact Us page, or our chatbot Quill, you consent to receive communications from us electronically. These communications satisfy any legal requirement that such notices be in writing.

SECTION 5 — THE ARTIFACTS (PRODUCT DISCLOSURE)

We strive to ensure that all product descriptions, images, and specifications accurately reflect the items offered.However, variations are a hallmark of the artisan process and may occur due to:

• Handmade Craftsmanship: Natural variation in botanicals, wax, mica, and oils.

• Display Differences: Device screens may display colors differently; we do not guarantee your monitor's display of any color will be accurate.

• Apparel Sizing: Fit expectations are based solely on measurements provided by Ash & Prose, LLC, not external marketplace standards. Minor variations do not constitute misrepresentation. We reserve the right to limit sales of our products or Services by person, region, or jurisdiction on a case-by-case basis within lawful means.

SECTION 6 — ORDERS, CANCELLATIONS & RETURNS

• Order Acceptance: Placing an order constitutes an offer to purchase. We may decline, limit, or cancel orders at our sole discretion.

• Mandatory Safety Acknowledgment: By purchasing flame-based products, you confirm that you have read and agree to follow all safety instructions provided through our included inserts, care emails, and website documentation. Failure to follow safety instructions voids all liability of Ash & Prose, LLC.

• Cancellations: Many items are made-to-order. Cancellation requests must be submitted within 24 hours of purchase. Orders cannot be canceled once production or fulfillment has begun.

• Returns: Items must be unused, unburned, and in original condition. Returns must be initiated within 30 days of delivery. Returns that do not meet these conditions (e.g., burned candles, washed and/or worn apparel) may be refused. Standard returns are not subject to restocking fees.

• Non-Returnable Items: Sales of digital products (once accessed), custom artifacts, and “Experience” boxes are final, except where required by law or explicitly stated in this policy.

• Chargebacks: You agree to contact us for resolution before initiating a chargeback. Ash & Prose, LLC maintains a zero-tolerance policy for payment reversal fraud. We reserve the right to recover funds and associated costs (including administrative and legal fees) in cases of fraudulent or invalid chargebacks. 

SECTION 7 — PRICES & SECURE BILLING

All prices are listed in USD and are subject to change without notice.

• Accepted Payment Methods: We accept major credit cards (Visa, Mastercard, American Express, Discover, Diners Club), digital wallets (Apple Pay, Google Pay, Meta Pay, PayPal, Shop Pay), and localized options enabled at checkout.

• Data Privacy & Security: Ash & Prose, LLC does not collect, store, or have access to your full credit card number, CVV, or sensitive financial credentials. While we receive transactional information such as your name, billing address, and email to fulfill your order, all sensitive payment data is handled exclusively by our PCI-compliant third-party processors. 

• Billing: Payment is collected in full at the time of purchase. All transactions are securely processed through Shopify Payments.

SECTION 8 — DISPATCH & DELIVERY (SHIPPING LOGIC)

Primary fulfillment originates from our studio in Grand Junction, Colorado, USA. To provide a diverse range of artifacts, some items (such as apparel) may be fulfilled and shipped via our vetted production partners and may arrive in separate parcels.

• Order Handling/Processing Time: 3–5 Business Days (Monday – Friday).

• Estimated Transit Time: 3–5 Business Days (Monday – Friday).

• Total Estimated Delivery Window: 6–10 Business Days. Delivery timeframes are estimates and not guaranteed.

• Risk of Loss: Risk of loss transfers to the customer once the order is handed to the shipping carrier (the “courier guild”). Carrier records, including delivery confirmation and tracking data, are considered definitive proof of fulfillment. 

• Theft/Loss: Ash & Prose, LLC is not responsible for 'Porch Piracy' or theft once a package has been marked as 'Delivered.' Customers must file claims directly with the shipping carrier.

SECTION 9 — INTELLECTUAL PROPERTY & DMCA

All content — including text, lore, artwork, logos, product names, designs, and the "Experience Architecture" — is the exclusive property of Ash & Prose, LLC. Designs are for personal use only and may not be reproduced or resold without written permission.

DMCA Notice: Claims of infringement may be submitted to support@ashprose.com. You will be REQUIRED to provide verifiable evidence of your claim before it will be reviewed.

False Claims & Misrepresentation: Ash & Prose, LLC reserves the right to seek damages, including costs and attorneys' fees, from any party that submits a false, bad faith, or frivolous infringement claim.

SECTION 10 — PROHIBITED USES & FRAUD PREVENTION

You agree not to use the Services for any unlawful purpose, fraudulent activity, or submission of false information. Fraudulent activity may result in permanent account bans, reporting to global fraud prevention databases, and legal action.

SECTION 11 — CONSUMER WELLNESS & SAFETY

• Apothecary Products: For external use only. Patch testing is recommended.

• Candle Safety: Never leave candles unattended. Trim wicks to 1/4 inch before lighting. Follow all candle safety instructions. 

• REMOVAL OF DECOR: ALL decorative elements (including botanicals, charms, or crystals) MUST be removed before burning to prevent fire hazards.

• Modification Disclaimer: Any modification of products (including adding oils or herbs) voids all warranties and liability. Ash & Prose, LLC is not responsible for damages resulting from altered products.

• General Disclaimer: Artifacts are intended for adult use only. Keep out of reach of children and pets.

SECTION 12 — OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools which we neither monitor nor have control over. We provide access to such tools ”as is” without warranties of any kind. We are not responsible for examining the content or accuracy of third-party materials or websites.

SECTION 13 — LIMITATION OF LIABILITY & WARRANTY DISCLAIMER

NO GUARANTEE: WE DO NOT WARRANT THAT YOUR USE OF OUR SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. THE SERVICE AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE.

LIMITATION OF LIABILITY: IN NO CASE SHALL ASH & PROSE, LLC, OUR DIRECTORS, OWNERS, OR EMPLOYEES BE LIABLE FOR ANY INJURY, LOSS, OR CLAIM EXCEEDING THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC ITEM IN QUESTION.

SECTION 14 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Ash & Prose, LLC and our affiliates from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or your violation of any law.

SECTION 15 — FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our control, including weather, natural disasters, pandemics, carrier delays, or labor disruptions.

SECTION 16 — SEVERABILITY & ENTIRE AGREEMENT

If any provision is found unenforceable, the remaining provisions remain valid. These Terms constitute the entire agreement between you and Ash & Prose, LLC. ANY AMBIGUITIES IN THE INTERPRETATION OF THESE TERMS SHALL NOT BE CONSTRUED AGAINST THE DRAFTING PARTY.

SECTION 17 — GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Colorado, USA. All disputes shall be resolved through binding arbitration in Colorado. You expressly waive your right to file a class action or seek relief on a class basis.

SECTION 19 — THE INNER CIRCLE (MEMBERSHIP & MARKETING) By subscribing to the Inner Circle (our electronic mailing list), you agree to the following:

• Consent: You expressly consent to receive recurring automated marketing emails, newsletters, and promotional artifacts from Ash & Prose, LLC.

• Rewards & Coupons: All "Inner Circle" exclusive discounts, coupon codes, and bonus content are for personal use only and are non-transferable. Coupon codes must be applied at the time of checkout and cannot be applied retroactively to completed orders.

• Abuse of Benefits: We reserve the right to cancel memberships or void discount codes if we suspect fraudulent activity, such as creating multiple accounts to harvest "New Member" rewards.

• Unsubscribing: You may depart the Inner Circle at any time by clicking the "Unsubscribe" link found at the foot of every raven (email) we send. Removal is permanent until you choose to re-initiate your quest by re-subscribing.
